Bucharest, 20 December 2022 – During today's meeting, the Council of the Financial Supervisory Authority (ASF) adopted measures on the functioning of the supervised non-bank financial markets - insurance, capital market and private pensions, as follows:
A) Regulation
Regulation amending and supplementing ASF Regulation no. 13/2019 on the establishment of measures to prevent and combat money laundering and terrorist financing through the financial sectors supervised by the Financial Supervisory Authority (the Regulation will be sent for publication to the Official Gazette of Romania);
Draft Rule for the application of the provisions of the EBA Guideline on the criteria for granting investment firms an exemption from liquidity requirements under Article 43 para. (4) of Regulation (EU) 2019/2033 (the draft will be published on www.asfromania.ro for public consultation for 10 days);
Notification to the European Banking Authority of the intention to apply the provisions of the Guidelines on benchmarking exercises on remuneration practices and the gender pay gap under Directive (EU) 2019/2034;
The ESMA notification of the A.S.F.’s intention to apply the ”Guidelines on the scope of the CRA Regulation (ESMA80-196-6345)”;
Draft Regulation supplementing Art. 2 para. (1) of the Financial Supervisory Authority’s Regulation no. 39/2015 on the approval of the Accounting Regulations in compliance with International Financial Reporting Standards, applicable to entities authorized, regulated and supervised by the Financial Supervisory Authority in the Financial Instruments and Investments Sector, as well as the Investor Compensation Fund (the draft will be published on www.asfromania.ro for public consultation for 10 days).
Draft Regulation on management fee for privately managed pension funds (the draft will be published on www.asfromania.ro for public consultation for 10 days).
Draft Rule amending Rule no. 11/2008 on the collection of individual contributions from participants in privately managed pension funds, as amended and supplemented, approved by the Decision of the Private Pension Supervisory Commission no. 23/2008 (the draft will be published on www.asfromania.ro for public consultation for 15 days).
B) Authorisation
Approval of Mr. Stefan Kutz for a new mandate as Chairman of the Supervisory Board of Signal Iduna Asigurare Reasigurare S.A.;
Approval of Ms. Natalia Man for a new mandate as Deputy General Manager of the company Pool-ul de Asigurare Împotriva Dezastrelor Naturale S.A. (PAID);
Authorisation of Mr. Cosmin - Antoine - Constantin Călin as member of the Board of Directors of BT Pensii - Societate de Administrare a Fondurilor de Pensii Facultative S.A.;
Approval of the increase of the share capital of Eurolife FFH Asigurări de Viață S.A.;
Approval of the modification of the shareholding and amendments to the provisions of the Articles of Incorporation of Asigest Broker de Asigurare-Reasigurare S.A.;
Approval of the application of Energeia Capital S.A. for registration as an Alternative Investment Fund Manager (AIFM) and entry in the ASF Register as a registered AIFM;
Approval of the new shareholding and amendments to the Articles of Incorporation of Millenium Insurance Broker (M.I.B.) S.A. (increase of share capital, change of company name and content of the Articles of Incorporation);
Authorisation of changes in the organisation and operation of Nova Vision Investments AFIA S.A., following the increase in share capital.
