Announcement on the selection process of a member appointed by the ASF for the position of Chairman of the Board of Directors of the Investor Compensation Fund, according to Law no. 88/2021 on the Investor Compensation Fund

Position requirements:

Members of the board of directors must cumulatively meet the conditions provided in art. 15 and not to be in situations of incompatibility/ conflict of interests according to art. 16 of Law 88/2021 on the Investor Compensation Fund, respectively:

 Art. 15. - The members of the Board of Directors of the Fund shall cumulatively meet the following conditions:

a) to be graduates of long-term university studies with a bachelor's degree or of short-term university studies with a bachelor's and master's degree in economics or law;

b) to have a good reputation and moral probity;

c) to have proven professional experience in the financial field or in the activity of regulation/ supervision of credit institutions, finance or the capital market of at least 8 years.

 Art. 16. - The members of the Board of Directors of the Fund shall cumulatively meet the following conditions:

a) not to be spouses, relatives or in-laws up to the second degree between them;

b) not to be senators, deputies, members of the Government or hold leadership positions within any political party or political organization during the exercise of the mandate;

c) not to have sanctions provided by law registered in their criminal record;

d) not to have sanctions provided by law registered in their fiscal record;

e) not to hold the quality of shareholder, employee or director, member of the board of directors, of the supervisory board or of the management, as the case may be, within any entity provided in art. 3 paragraph (1);

f) not to have been convicted in the last 5 years for committing any offense provided by the legislation in the financial-banking field, the legislation on insolvency or consumer protection;

g) not to have been sanctioned by the ASF or the National Bank of Romania with the prohibition of carrying out activities on the markets supervised by them.

Content of the application file:

a) Curriculum Vitae in Europass format, signed and dated;

b) Letter of motivation, signed and dated;

c) Criminal record within the validity period;

d) Fiscal record within the validity period;

e) Certified true copies of the documents attesting the studies (study diplomas, certificates, attestations, transcripts, etc.);

f) Certified true copies of the documents attesting the professional experience, seniority in work and specialty (labor record, certificate attesting the seniority in work, profession and specialty, REVISAL extract, etc.);

g) Affidavit according to which the declarer meets the conditions provided by law, signed and dated. This document can be downloaded here

i)  Certified true copies of the identity document.

For documents that are in a language other than Romanian, in addition to the copy of the initial document, the legalized translation into Romanian shall also submitted.

Rules for submitting application files:

• The application files are sent until July 9, 2021, at 23:59, to the e-mail address: candidați_FCI@asfromania.ro
• The size of the e-mail for sending documents must not exceed 5 MB, if the size of the documents exceeds this size, several e-mails with the same subject but with different attachments are accepted.
• In the process of sending files, only e-mail addresses to the sender are used and which are not automatically generated by applications or websites (such as those generated by file transfer websites announcing file download links).
• it is not allowed to transmit attachments with the extensions: .exe; .com or .Ink.
• Transmission of password attachments is not allowed.
• There must be no links to websites in the subject or body of the messages.
• documents transmitted by online file transfer will not be downloaded and will not be taken into account.
• documents are scanned individually, saved in .pdf format and attached to the same e-mail.
