Bucharest, 4 February 2025 - In January 2025, the courts ruled in favour of AFS in the following relevant cases:
By Judgment no. 123/17.01.2025, the court rendered a partially favourable ruling for ASF, against the appellant-claimant Renato Szilagyi, as Chairman of the Supervisory Board of Asigurare-Reasigurare City Insurance S.A. at the sanctioning date.
The solution in a nutshell:
“Admits the appeal lodged by the claimant Renato Szilagyi against Judgment no.1049 of 24 May 2022 rendered by Bucharest Court of Appeal - 9th Division for Administrative and Fiscal Litigation. Quashes the judgment under appeal and, in the retrial: Admits, partially, the action lodged by the claimant Renato Szilagyi against the defendant the Financial Supervisory Authority. Partially annuls Decision no. 83/25.01.2021 issued by the Financial Supervisory Authority, on the sanction of the fine applied, which reduces it from Lei 530,000 to Lei 250,000. Upholds the remainder of the judgment under appeal.

Subject matter: The appeal lodged by the appellant-claimant against the civil judgment no. 1049/24.05.2022, by which the Bucharest Court of Appeal rejected the appellant’s action as unfounded.
Notes: On the merits, the case concerned the action lodged by the appellant-claimant, as Chairman of the Supervisory Board of Asigurare-Reasigurare City Insurance S.A., by which he requested the court, mainly, among others, (i) the certification of the nullity of Art. 1 of the AFS Decision no. 83/25.01.2021 and (ii) the annulment of Art. 1 of the ASF Decision no. 83/25.01.2021 regarding the sanctioning of Mr. Renato Szilagyi with a fine of Lei 530,000.
In particular, by its ruling, the High Court of Cassation and Justice validated the judgment rendered by the first court and, implicitly, maintained, as thorough and legal, the ASF Decision no. 83/25.01.2021, reducing only the amount of the fine applied from Lei 530,000 to Lei 250,000.

By Judgment no. 98/17.01.2025, the court ruled in favour of ASF, against the appellant Ştefan Claudiu Iulian, as Chairman of the Board of Directors of Mettexin S.A. at the sanctioning date.
Subject matter: The appeal lodged by the appellant-claimant against the civil judgment no. 2080/15.12.2023, by which the Bucharest Court of Appeal dismissed the action as unfounded.
Notes: On the merits, the file concerned the request for a summons in which the appellant-claimant requested the court of law:
- to suspend the trial of the case until the final ruling of the case subject to file no. 4126/2/2022;
- to annul ASF Decision no. 1743/29.12.2022, whereby the appellant-claimant was sanctioned with a fine of Lei 59,300, as chairman of the Board of Directors of Mettexin S.A.
