Decisions adopted by the Board of the Financial Supervisory Authority

Bucharest, 23 August 2023 – During today's meeting, the Council of the Financial Supervisory Authority (ASF) adopted measures on the functioning of the supervised non-bank financial markets - insurance, capital market and private pensions, as follows:

A)  Regulation

Draft Instruction for the application of the Guidelines on the use of remote customer onboarding solutions under Article 13(1) of Directive (EU) 2015/849 (the draft will be published on www.asfromania.ro for public consultation for 15 days);

Draft Rule amending and supplementing the Financial Supervisory Authority's Rule No 10/2014 on the activity of deposit and custody of assets of voluntary pension funds, in order to initiate the public consultation process (the draft will be published on www.asfromania.ro for public consultation for 15 days);

Draft Rule amending and supplementing the Financial Supervisory Authority's Rule No 11/2014 on the activity of deposit and custody of assets of privately managed pension funds (the draft will be published on www.asfromania.ro for public consultation for 15 days).

B) Authorisation

Approval of Mr Adrian-Constantin Marin for a new mandate as Member and Chairman of the Board of Directors of Generali Romania Asigurare Reasigurare S.A.;

Approval of Mr. Bucur Mihail as Executive Officer of Titan Broker de Asigurare S.R.L.;

Approval of Mr. Dolea Florin as manager of Amundi Asset Management S.A.I. S.A.;

Approval of the application for authorisation of Stockestate Crowdfunding S.R.L. as a provider of participatory financing services;

Approval of the application of S.A.I. Atlas Asset Management S.A. for the authorization of the Alternative Investment Fund with private capital Atlas Opportunity and its registration in the public register of ASF as such;

Approval of the amendment to the Articles of Incorporation of Brokasig Broker de Asigurare S.R.L. concerning the addition of the object of activity;

Approval of amendments to the Articles of Incorporation of Campion Broker de Asigurare și Reasigurare S.R.L. (acquisition of shares by succesion, significant new shareholder, shareholder structure);

Approval of amendments to the Articles of Incorporation of SIS Broker de Asigurare S.R.L. (registered office, new shareholder structure as a result of the transfer of shares, revocation of the director's term of office and amendment of the directors' term of office);

Approval of the application for final approval of the amendment to the Prospectus of the voluntary pension scheme for the Voluntary Pension Fund BCR Plus, managed by BCR Pensii Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the application for authorisation to amend the Individual Membership Deed of the Voluntary Pension Fund BCR Plus, managed by BCR Pensii Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the application for the authorisation to amend the Investment Policy Statement for the Voluntary Pension Fund Pensia Mea managed by BT Pensii Societate de Administrare a Fondurilor de Pensii Facultative S.A.;

Approval of the application for the authorisation to amend the Investment Policy Statement for the Privately Managed Pension Fund Aripi, managed by Generali Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the application for approval of the amendment to the Prospectus of the private pension scheme for the Privately Managed Pension Fund Aripi managed by Generali Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the application for authorisation to amend the Investment Policy Statement for the Voluntary Pension Fund Stabil, managed by Generali Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the application for the authorisation to amend the Custody Agreement for the assets of the Voluntary Pension Fund NN Activ managed by NN Asigurări de Viață S.A.;
