Decisions adopted by the Board of the Financial Supervisory Authority

Bucharest, 30 June 2021 – During today’s meeting, the Financial Supervisory Authority’s Board (A.S.F.) has approved some measures with regard to the operation of non-banking supervised financial markets – insurance, capital market and private pensions, as follows:

 

A)  Regulation

The draft rule on the application of the Guidelines on outsourcing to cloud service providers (the draft will be published for 10 days on www.asfromania.ro for public consultation);

The draft regulation amending and supplementing the A.S.F. Regulation no. 4/2021 regarding the inspection activity carried out by the Financial Supervisory Authority (the regulation will be sent for publication to the Official Gazette of Romania).

 

B)   Authorization

Authorization of Mr. Bulimente Mario - Paul as executive officer of SSIF Finaco Securities S.A.;

Authorization of Ms. Barbu Nicoleta Andreea and Mr. Săndiță Adrian Victor as executive officers of SSIF Share Invest S.A., and approval of amendment of art. 2 of A.S.F. Decision no. 1183/02.10.2020 regarding the duration of the suspension of the operating license of SSIF Share Invest S.A.;

Authorization of Ms. Anne-Marie Mancaș as member of the management board of Generali Societate de Administrare a Fondurilor de Pensii Private S.A.;

Authorization of Mr. Dragoș-Mihai Neamțu as member of the management board of Generali Societate de Administrare a Fondurilor de Pensii Private S.A.;

Authorization of Mr. Valentin – Daniel Moisuc as member of the management board of Generali Societate de Administrare a Fondurilor de Pensii Private S.A.;

Authorization of Ms. Livioara Andra Farcaș as member of the Board of Directors of Allianz-Țiriac Pensii Private Societate de Administrare a Fondurilor de Pensii Private S.A.;

Authorization of Mr. Nicolae Cătălin Munteanu as member of the Board of Directors of S.A.I. Raiffeisen Asset Management S.A.;

Approval of the amendments to the Code of the Bucharest Stock Exchange S.A. - Multilateral Trading System;

Authorization of S.I.F. Banat - Crișana S.A. as an Alternative Investment Fund for closed-end, diversified retail investors (F.I.A.I.R.) and its registration in the A.S.F. in this capacity;

Authorization of the changes in the documents of the open-end investment fund managed by S.A.I. Raiffeisen Asset Management S.A. in order to align them to the provisions of Regulation (EU) no. 2088/2019 on sustainability‐related disclosures in the financial services sector;

Issuing a decision confirming that Bombardier Transportation Shared Services Romania S.R.L., engaged in intragroup transactions with over-the-counter derivatives with Alstom Holdings, benefits from the exception to the reporting obligation, based on article 9 para. (1) of Regulation (EU) no. 648/2012 (EMIR);

Approval of the acquisition project submitted by Țiriac Asset Holdings Limited and Țiriac International Foundation for the acquisition of a qualified direct and indirect interest in the share capital of Allianz - Țiriac Asigurări S.A.;

Approval of the acquisition project submitted by the company Allianz Holding eins GmbH for the acquisition of a qualified direct interest in the share capital of Allianz-Țiriac Asigurări S.A.;

Approval of the amendment to the Regulation on the Organisation and Operation of Generali Societate de Administrare a Fondurilor de Pensii Private S.A.;

Approval of the amendment to the Prospectus of the private pension scheme for the Privately Managed Pension Fund BRD, managed by BRD Societate de Administrare a Fondurilor de Pensii Private S.A.;

Prior approval of the amendment to the Prospectus of the voluntary pension scheme for the Voluntary Pension Fund BRD Medio, managed by BRD Societate de Administrare a Fondurilor de Pensii Private S.A.
