Decisions adopeted by the Council of the Financial Supervisory Authority - 13.05.2020

Bucharest, May 13th, 2020 – During the meeting held today, the Council of the Financial Supervisory Authority (Ro. ASF) has approved measures regarding the operational framework of the supervised financial non-banking markets - insurance, capital market and private pensions, among which:

A)  Regulation

The Draft Regulation for amending and supplementing the Regulation of the Financial Supervisory Authority no. 16/2014 on the revenues of the Financial Supervisory Authority (the draft will be published on www.asfromania.ro, for public consultation, for 15 days);

Implementation of the ESMA Guide on standardized procedures and messaging protocols in accordance with Article 6 para. (2) of (EU) Regulation no. 909/2014.

B)  Monitoring

Sanctioning brokerage companies that did not comply with the legal provisions regarding the transmission of periodic reports to the Financial Supervisory Authority; 

The results of the periodic inspection performed at SAI Vanguard Asset Management SA (current SAI Tradeville Asset Management SA);

The results of the periodic inspection performed at Certinvest Pensions  Management Company of the Facultative Pensions Fund as administrator of FPF My Pension.

C)  Authorization

Appointment of Mr. Marian - Constantin Zlătaru for a new mandate in the position of Deputy Director General at the company Asito Kapital SA;

Extension by 2 years of the maximum audit period of 5 consecutive years by the current financial auditor G5 Consulting SRL of the financial statements of the Open-End Investment Funds FIX Invest and Prosper Invest, as well as of the Closed-End Investment Funds BET-FI Index Invest, Smart Money and Optim Invest managed by SAI Broker SA, for the years 2020 and 2021;

Approval of the EU prospectus for growth for the augmentation of the share capital of Serico SA Bucharest;

Issuance of the Certificate of Registration of the bonds issued by the company Norofert SA Bucharest for admission to trading on the Multilateral Trading System administered by the Bucharest Stock Exchange (Ro. BVB).
