Decisions adopted by the Council of the Financial Supervisory Authority - 22.04.2020

Bucharest, April 22nd, 2020 – During the meeting held today, the Council of the Financial Supervisory Authority (Ro. ASF) has approved measures regarding the operational framework of the supervised financial non-banking markets - insurance, capital market and private pensions, among which:

 

A)  Regulation

The Draft Regulation for amending and supplementing some normative acts issued by the Financial Supervisory Authority - the draft will be published on www.asfromania.ro, for public consultation, for 15 days;

The notification of the European Supervisory Authorities: ESMA, EIOPA and EBA (AMLSC) on the intention of the FSA to comply with the Guidance on Cooperation and Exchange of Information for the purpose of (EU) Directive 2015/849 between the competent authorities that supervise the credit and financial institutions;

The Draft Rule for amending the annex to the Norm of the Financial Supervision Authority no. 13/2018 for the application of the ESMA Guide on crisis scenarios under art. 28 of (EU) Regulation no. 1131/2017 on money-market funds - the project will be published on www.asfromania.ro, for public consultation, for 10 days;

The Regulation for the adoption of exceptional measures applicable to the authorized entities, regulated and supervised by the FSA (Ro. ASF) – The sector of financial instruments and investments during the establishment in Romania of the state of emergency generated by the COVID-19 crisis - the regulation will be sent, for publication to the Official Gazette of Romania;

Regulation no. 9/2020 for the amendment and completion of some normative acts of the Financial Supervisory Authority - the regulation will be sent, for publication, to the Official Gazette of Romania. 

 

B)  Authorization

The amendments brought to the Articles of Incorporation of the company Agricover Insurance Broker SRL, (Agricover Broker de Asigurare SRL), (increase of the share capital by co-opting a significant new partner, the structure of the partners, change of the name of the company and elimination of the CANE code from the secondary activity);

Extension by two years of the maximum audit period of five consecutive years of the company SAI Muntenia Invest SA by the current financial auditor, KPMG Audit SRL, respectively for the financial statements for the years 2020 and 2021; 

Issuance of Certificates of Registration of structured products issued by Erste Group Bank AG. 

 

C)   Miscellaneous

The report on private pensions in Romania as of December 31st, 2019.
